Terms of Service
Last updated: 10 June 2026. These Terms are governed by the laws of Malaysia.
1. Parties & how to read these Terms
These Terms of Service (“Terms”) form a binding contract between you and Hartanahub [Sdn Bhd / Enterprise — SSM registration number to be inserted on approval](“Hartanahub”, “we”, “our”, “us”) governing your use of the Hartanahub web app, mobile PWA, marketing site, APIs, and any related services (collectively, the “Service”).
By creating an account, paying for any feature, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of an employer, agency, financial institution, or other organisation, you confirm you are authorised to bind that organisation to these Terms.
Capitalised terms not defined in-line have the meanings given to them in the Privacy Policy.
2. The Service
- Hartanahub consolidates publicly available auction listings, government property-transaction records (JPPH), and user-submitted content into a search, tracking, and analysis platform.
- We work hard to keep the data current (twice-daily refresh) and accurate, but we make no warranty of completeness, accuracy, timeliness, or fitness for any particular purpose. Reserve prices, auction dates, bank assignees, lawyers, and auctioneers can change or be cancelled at short notice — always verify directly with the auctioneer or assignee bank before attending an auction or making a bid.
- Market valuation briefs, comparables, the auction cost breakdown, the loan calculator, the commission calculator, and any AI-assisted features are informational estimates, not professional valuations, legal advice, financial advice, or tax advice. Do not substitute them for advice from a licensed valuer, lawyer, banker, accountant, or licensed financial planner.
- We may modify, suspend, or discontinue any feature of the Service at any time. Material reductions to the Service available on a paid tier will be communicated in advance and refunded pro rata where required by law.
3. Eligibility & account
- You must be at least 18 years old and have legal capacity to enter into a contract under Malaysian law.
- One account per person. Sharing credentials with another individual or organisation is not permitted. Organisation use requires individual accounts for each user.
- You are responsible for keeping your password secure. We recommend using a reputable password manager. Notify us immediately at security@hartanahub.com if you suspect unauthorised access.
- You agree to provide accurate, complete, and current account information and to keep it up to date.
- We may suspend or terminate accounts that automate queries, scrape bulk data, share credentials, misrepresent licence status, or otherwise abuse the platform. Rate limits apply on sensitive endpoints and login attempts.
4. Subscriptions, billing & refunds
- Premium and Agent tiers are billed monthly or annually via our payment processor, Stripe. Prices shown on Pricing are in Malaysian Ringgit (MYR) and inclusive of applicable Service Tax (SST) where Hartanahub is SST-registered.
- Auto-renewal: by subscribing, you authorise us to charge your saved payment method on each renewal date — monthly or annual, matching your chosen plan — until you cancel. Renewal pricing matches the plan you signed up for unless you switch tiers; we email a renewal receipt each time. You can cancel auto-renewal at any time from the billing portal in Settings; cancelling stops the next charge and you retain access until the end of the current paid period.
- 14-day refund: first-time paid subscribers who cancel within 14 days of first payment will receive a full refund, no questions asked. Email billing@hartanahub.com.
- After the 14-day window, cancellations stop the next renewal but do not pro-rate the current period.
- We may change pricing with at least 30 days' notice. Existing annual subscribers retain their price for the remainder of the paid term.
- You are responsible for any taxes that apply to your use of the Service in your jurisdiction other than SST that Hartanahub is required to collect at source.
5. Agent features & licence verification
- Agent and Premium Agent tiers require a valid Real Estate Negotiator (REN) number issued by the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEP). We may verify licence status with BOVAEP at any time. Misrepresentation is grounds for immediate termination and may be reported to BOVAEP and to MACC where appropriate.
- The commission calculator, tax tracker, and net-commission features are informational aids based on the SRO 2023 legal scale and Malaysian tax brackets. You remain responsible for filing accurate returns with LHDN and for compliance with BOVAEP rules.
6. Partner institutions (banks, law firms, auctioneers, partner agents)
- The Service may surface enquiry, quotation, or referral flows to partner institutions you select (for example, a bank-financing indication on a specific auction property). Where you initiate such a flow, you authorise us to share with the selected partner the personal data necessary to action your enquiry, as further described in the Privacy Policy.
- Partner institutions are independent third parties. The terms on which a partner provides financing, legal services, or auction representation are governed by a separate agreement directly between you and that partner. Hartanahub is not a party to that agreement and is not a credit provider, financial adviser, valuer, law firm, or auctioneer.
- We do not receive any portion of a loan amount, settlement amount, or auction proceeds. Where a partner pays Hartanahub a referral, technology, or data-licensing fee, that fee does not change the price you pay the partner.
- Partner institutions are bound by written data-sharing and confidentiality agreements that prohibit unrelated re-use of your data.
7. Content you submit
- You retain ownership of the documents you upload to your vault, the auction records you log, the notes you write, and the properties you self-register as an owner.
- You grant us a worldwide, non-exclusive, royalty-free, revocable licence to host, store, display, and process that content for the sole purpose of operating the Service for you. We do not resell your content.
- You represent and warrant that you own, or have all necessary rights to upload, the content you submit, and that it does not infringe any third-party intellectual-property, privacy, or contractual right.
- Do not upload content that is illegal, defamatory, obscene, infringing, or that contains malware or executable code.
8. Acceptable use
You must not, and must not permit anyone else to:
- Use the Service to harass, threaten, defraud, or impersonate another person;
- Scrape, crawl, mass-download, or otherwise extract Service data by automated means without our prior written consent;
- Circumvent any technical access control, paywall, rate limit, or audit log;
- Resell, sublicense, or commercially exploit the Service or its data without a written commercial agreement;
- Use the Service to launder money, finance terrorism, or evade sanctions; cooperate with Hartanahub on any Anti-Money-Laundering / Counter-Financing of Terrorism (AML/CFT) or sanctions-screening request applicable under Bank Negara Malaysia AMLA 2001 and similar law;
- Reverse-engineer, decompile, or attempt to derive source code from the Service, except to the limited extent that applicable law expressly permits;
- Misrepresent your professional licence status (e.g. claim to be an REN when you are not);
- Use the Service to interfere with any auction process or to coordinate bidding in a manner that is unlawful under the Auction Sales Act 1952 or related rules.
We will cooperate with law enforcement and regulators on verified complaints, including PDRM, MACC, LHDN, Bank Negara Malaysia, and BOVAEP.
9. Intellectual property
- The Service, including all software, design, text, graphics, logos, the Hartanahub name and marks, the data-pipeline tooling, and the aggregated property database, is owned by Hartanahub or its licensors and is protected by Malaysian and international intellectual-property law.
- We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal-business use in accordance with these Terms.
- You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted in these Terms.
- Feedback or suggestions you provide may be used by Hartanahub without restriction or compensation.
10. Third-party services & links
The Service may link to or integrate with third-party websites and services (for example, an auctioneer's public listing page, a partnering bank's loan-application portal, or a payment provider). Your use of those third-party services is governed by their own terms and privacy policies. Hartanahub is not responsible for third-party services and disclaims liability for them to the maximum extent permitted by law.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service will meet your requirements.
12. Limitation of liability
To the maximum extent permitted by Malaysian law:
- Hartanahub's total aggregate liability arising out of or in connection with these Terms or your use of the Service is limited to the fees you have paid to Hartanahub in the 12 months immediately preceding the event giving rise to the claim, or MYR 500, whichever is greater.
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, or losses arising from auction outcomes, bid decisions, market movements, or third-party actions.
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Malaysian law (including liability for fraud, gross negligence, or death or personal injury caused by negligence).
13. Indemnity
You agree to indemnify and hold harmless Hartanahub, its officers, employees, and partners from and against any third-party claim arising out of or related to (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) content you submit to the Service. Hartanahub will give you prompt notice of any such claim and reasonable cooperation at your expense in the defence of the claim.
14. Termination
- You may close your account at any time from the Settings page.
- We may suspend or terminate your access to the Service if you breach these Terms, if continued provision would expose Hartanahub to legal or reputational risk, or as required by law or regulator. We will provide reasonable notice where practicable, except for breaches requiring immediate action.
- On termination, paid subscriptions cease (subject to the refund provisions in clause 4) and your personal data is purged per the Privacy Policy. Provisions that by their nature survive termination (including clauses 7, 9, 11, 12, 13, 16, 17, and 18) survive.
15. Force majeure
Neither party is liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authority, fire, floods, accidents, pandemics, network outages, or systemic third-party service failures. The affected party will use reasonable efforts to resume performance as soon as practicable.
16. Governing law & dispute resolution
- These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws principles.
- The parties will attempt in good faith to resolve any dispute by negotiation. If a dispute is not resolved within 30 days of written notice, the parties may submit it to mediation through the Asian International Arbitration Centre (AIAC) in Kuala Lumpur.
- If mediation is unsuccessful, the courts of Kuala Lumpur have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any competent court.
17. Notices
Legal notices to Hartanahub must be sent to legal@hartanahub.com and, once SSM registration is finalised, to our registered office address listed in the Privacy Policy. We will send notices to the email address on your account; you are responsible for keeping that address current.
18. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any order form or commercial agreement we sign with you, constitute the entire agreement between us and supersede prior agreements on the same subject matter.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be reformed to the minimum extent necessary to make it enforceable.
- No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of substantially all assets, on notice to you.
- No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Hartanahub.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Language. These Terms are written in English; the English version prevails over any translation.
19. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page and notified to registered users by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
